General Terms of Use (GTU) – Opla
Preamble
The “Opla.co” application and the www.opla.co Website are published by Opla (hereinafter referred to as “Opla”), a simplified joint-stock company with share capital of 20,020.00 euros, whose registered office is located at 4 rue Louis Armand – 27930, Gravigny, registered with the Trade and Companies Register of Évreux under number 953 126 232.
The Marketplace service (the “Marketplace”), as described in these General Terms of Use, is intended to connect non-commercial buyers (the “Buyers”) and professional or private sellers (the “Sellers”) offering for sale new, second-hand products that have been reconditioned or handmade at a fixed price (the “Products”). Generally speaking, any visit to the Application or the Site implies the Buyer's acceptance of these General Terms of Use. Opla reserves the right to modify these General Terms of Use at any time by publishing a new version.
Definitions:
Each of the terms mentioned below shall have, in these General Terms of Use of the Application or the Site (hereinafter referred to as the "GTU"), the following meaning:
Application: refers to the Android application that can be downloaded free of charge onto an Android phone from the Google Play Store, and the application optimized for iPhone and iPad that can be downloaded from Apple's App Store free of charge onto an iPhone or an iPad.
Site: refers to the website accessible via the url “www.opla.co”.
Platform: refers to the Application and/or the Site, as well as all the Services offered by Opla.
Product / Good / Item: refer indifferently, in these GTU, to any object offered for sale on the Platform.
Listing: refers to the offer for sale of one or more Products published by a Seller on the Platform.
Secure Payment: refers to the intermediated payment service offered by Opla, by which the price paid by the Buyer is held by Opla then paid to the Seller after validation of the Transaction, and which opens the benefit of Opla Protection.
Transaction / Order: refers to the purchase-sale operation concluded between a Buyer and a Seller via Secure Payment.
Paid Options: refers to the paid services offered by Opla, in particular the listing boost and the dressing boost (see Article 11).
Account: refers to the User's personal space on the Platform. The Personal Account is that of a Private Seller; the Pro Account is that of a Professional Seller.
Review: refers to the feature made available to Opla Users allowing them to rate a Seller or a Buyer. Posting a review is only permitted after a Transaction has taken place between them. The review takes the form of a rating ranging from 1 to 5 stars displayed on the Users' profile. This rating may be accompanied by a comment. Parcel: refers to the package carefully wrapped by the Seller, onto which is affixed the shipping label (the “Bon d'Envoi”) corresponding to the carrier chosen among those offered by Opla (Mondial Relay, InPost, Colissimo, etc.). Opla Protection: refers to the fees charged by Opla SAS to Buyers in consideration for the use of Secure Payment. This protection also serves to protect Buyers in the event of a parcel lost or parcel damaged during transport.
Messaging: refers to the messaging system made available to Users allowing them to communicate by exchanging private messages that only they can view. Messaging is accessible to Users with an Account and makes it possible to make an offer on a product. Notifications: refers to the notifications received by Users. Notifications are only accessible to Users with an Account from the Application.
Wallet: refers to the payment account onto which sums are paid following transactions on the Application or the Site User: refers to any person of legal age using the Opla.co Application or the Site
Buyer: refers to any natural person of legal age holding a User Account who proceeds, from a Listing, to purchase one or more Goods on the Site from a Seller via Secure Payment.
Seller: refers to any Private or Professional Seller, aged 18 or over, who offers one or more Goods for sale and uses Secure Payment.
- Private Seller: refers to any Private Advertiser, holding a Personal Account, who offers one or more Goods for sale and uses Secure Payment.
- Professional Seller: refers to any Professional Advertiser, holding a Pro Account, who acts within the framework of their professional or commercial activity, and offers one or more Goods for sale and uses Secure Payment.
Article 1 - Purpose
These General Terms of Use (GTU) govern access to and use of the Opla platform, accessible via the mobile Application or the Site. They apply to all users, whether private individuals or professionals.
Any User, Buyer, Seller accessing and consulting the platform declares that they have read these General Terms of Use and expressly accept them without reservation and/or modification of any nature whatsoever. These GTU are therefore fully enforceable against Users, Buyers and Sellers. Any processing of personal data within the framework hereof is subject to the provisions of our privacy policy, which forms an integral part of these GTU. By using Opla, you accept these GTU without reservation.
Article 2 - Description of Opla services
Opla is above all a platform enabling the connection between a Buyer and a Seller in the simplest of ways. Opla thus makes it possible to buy and sell new, handmade or second-hand goods in France, Belgium, Luxembourg, the Netherlands, Spain and Portugal.
The Services include:
- Connecting Users by offering Sellers the possibility of creating listings on the Application or the Site and by offering Users a database allowing them to find suitable results;
- Access for Buyers to information about Sellers and to comments from other Users;
- The possibility for a Buyer to make offers concerning one or more products (lot) and the possibility for a Seller to refuse or accept these offers. Once confirmation has been made, the Buyer and the Seller are bound by a purchase.
- The possibility of creating and modifying one's profile as well as one's personal information (nickname, photo, name, etc.)
- Secure payment of products.
- The possibility of saving “favorite” products.
- The possibility of modifying or deleting one's listings.
- The possibility of activating “vacation” mode when the user is unable to ensure the shipment of their potential sales.
- Access to a secure messaging service.
- The possibility of making a transfer to one's bank account.
- Performing a search.
- The possibility of leaving a review for a User. It is recalled that the ratings contained on the platform are provided for information purposes only and do not constitute an opinion on the part of Opla. The ratings reflect the opinions of Users who have placed Orders or through Opla. The statements, advice or opinions provided by these individuals are their own and not those of Opla.
- A consignment service.
- Possibility of referring a friend. During a referral, the referrer receives €5 to spend on Opla and the referred person obtains a €5 discount on their first order (from €15). There is no limit on the number of referrals. Opla specifies that any fraud or abusive behavior may suspend participation in the referral program and the voucher may not be issued.
Article 3 - Account management
Creating an account:
In order to access Opla's services, the User must create an account by registering free of charge on the Application or the Site. The User undertakes to register using a single email address. The User must be of legal age, legally capable of contracting and of using the Application or the Site in accordance with these GTU. The User undertakes to provide accurate information and to update it immediately in the event of any change. Selling on Opla is reserved for persons aged 18 or over. Opla reserves the right to suspend or close any account that does not meet this condition. Access to the account created is protected by a login (the User's email address) chosen by the User upon registration on the Application or the Site. Users are solely responsible for any use that may be made of their login, and are solely responsible for its confidentiality, as well as for any use of their accounts.
Professionals must open an account as professionals and indicate in all registration messages that they are acting as professionals. Otherwise, the professional User is exposed to the sanctions provided by the applicable legislation in their country of residence, in particular regarding misleading commercial practices, which may include administrative, civil or criminal fines and prison sentences.
Opening a professional account requires subscribing to a subscription. Several offers are available. A standard offer, a premium offer and a tailor-made offer. The price of the subscription varies depending on the offer chosen.
The professional subscription (depending on the offer) makes it possible to obtain numerous advantages such as obtaining the pro badge, a human and responsive customer service, free listing boosts, etc.
When opening a professional account, the User must also provide a SIRET number (a unique identification number for your company) and other information relating to their company. This will make it possible to confirm its identity. Deleting an account Users may delete their accounts on the Application or the Site. The account will then be automatically deleted by Opla. All Item Listings that the User may have published will also be permanently deleted. The User's account will not be deleted as long as a sale is in progress, whether the User is a Seller or a Buyer.
In the event that Users provide false, inaccurate, outdated or incomplete data or if Users violate these GTU in any way whatsoever, Opla shall be entitled to suspend or close the User's account and to deny them access to all or part of the Services in the future.
Article 4 - Products and Prices
For sales between private individuals or professionals.
Authorized products:
Users may post only the following items online:
- Clothing, footwear and accessories for children aged 0 to 16.
- Clothing, footwear and accessories for adults (men and women).
- Maternity clothing and accessories suited to pregnancy and breastfeeding.
- Toys, books, furniture and childcare items for children.
- New and sealed Pokémon boosters.
- New hygiene and cosmetic products, with a best-before date not exceeded.
- Food products for babies/children, new and with a best-before date not exceeded.
- Home items: furniture, decoration, textiles, bedding, kitchen utensils, dishware.
- Small household appliances: food processors, cooking appliances, irons, vacuum cleaners, etc.
- Safety equipment for babies/children (new car seats).
- High-tech items, consoles and multimedia products for babies, children and teenagers.
Hygiene and safety rules:
- All consumables must be new, sealed, with a best-before date not exceeded and indicated in the listing.
- Pacifiers, baby bottles and teething rings must be new and sealed.
- Car seats must be new.
- Washable diapers: washing at 60°, stripping, disinfection, second complete wash at 60°.
Handmade products (artisanal creations):
- Original artisanal creations (textiles, decoration, accessories, non-precious jewelry, toys made of safe materials). The Seller warrants being the author of the item and holding all related rights.
Prohibited products:
Users may not post online:
- Items having only a photo generated by an AI (artificial intelligence) model or a carousel of photos whose main photo is generated by an AI model.
- Items not compliant with the laws of France, Luxembourg, Belgium, the Netherlands, Spain and Portugal.
- Counterfeit items.
- Items infringing intellectual property rights.
- Firearms, explosives, tasers.
- Samples, testers, free products not intended for sale.
- Low-value items likely to be drop-shipping or purchased via wholesalers.
Household appliances and home
- Large household appliances (dishwasher, washing machine, oven…).
- Thermomix food processors.
Products whose brand is the following:
- Temu and Shein.
Products posing a risk to health or hygiene
- Items requiring a prescription, medical supplies, vitamins, supplements, serums, oral solutions.
- Medical devices and any product subject to the pharmaceutical monopoly.
- Food, hygiene or cosmetic products already opened/used.
- Fresh food products.
- Bottled milk or baby bottle milk (UHT, pasteurized, raw).
- Opened packs of diapers.
- Tobacco products, electronic cigarettes, accessories.
- Underwear even if new.
- Recalled products.
IMPORTANT:
Opla reserves the right to remove an item or suspend an account if the user posts items that do not comply with the above rules.
Sanctions for publishing a prohibited product
Opla applies a graduated scale of sanctions:
- 1st breach: warning and immediate removal of the listing.
- 2nd breach: temporary account suspension of 7 to 30 days. Paid options (boost, pro subscription) already consumed are not refunded.
- 3rd breach or serious breach (counterfeiting, weapons, products dangerous to health): permanent account suspension.
In the event of suspension, the sums held in the User's wallet remain recoverable by bank transfer after identity verification, subject to the completion of ongoing transactions and the absence of any dispute. The User may contest a sanction by writing to contact@opla.co within 14 days. Opla undertakes to provide a reasoned response within 15 business days.
Prices:
On each listing, two prices are indicated.
A price decided by the seller (Sale price) and a price including the sale price + Opla Protection (Total sale price).
The amount of Opla Protection is 5% + 70 euro cents of the product or of the entire lot.
Article 5 - Consignment Sale
In addition to being able to sell their items themselves, the User may also send their clothing to Opla so that Opla sells it for them.
Step by step:
- This is a complementary service reserved solely for clothing. Sending clothing is done via a shipping label that costs €1.99 in France and €5.99 from abroad. The user may use all the payment methods of Article 7.
If the User wishes, Opla may return the rejected clothing to them after the sorting stage, for a payment of €10.00. If the user has paid these €10.00 and all the clothing is accepted, they will then be refunded.
- All clothing brands are accepted (except Shein and Temu) as well as all sizes. However, the clothing must be impeccable (clean, without stains, without holes, without cracking on the patterns, without excessive signs of wear), and the brand as well as the size must be indicated on one of the garment's labels.
- Once sorting is done, the clothing will be imported by Opla onto the platform. The clothing will appear on the User's profile as soon as it is imported. It is Opla who sets their price.
- The “consignment sale” period lasts 6 months.
- If during these 6 months, an item of clothing is sold (and the buyer accepts the sale), the User will receive 50% of the amount of the sale price (excluding Opla protection and shipping fees) onto their Opla wallet.
- During this 6-month period, the User may decide to donate to Opla the unsold clothing at the end of this period. If the User donates them, they then become the property of Opla. If the user wishes to recover the unsold clothing at the end of the “Consignment Sale” period, they will have to pay €10.00. These €10.00 cover the shipping fees as well as the preparation of the lot of clothing to be taken out of stock.
Article 6 - Orders
A purchase on Opla, between two private individuals, is carried out according to the following terms:
- An offer to purchase (or not) on a product or on a lot of products.
- Negotiation of the Sale price
The Buyer has the possibility of clicking on “Make an offer” which will allow them to indicate their price proposal in the messaging. The Seller can then accept or refuse the Offer.
- Acceptance of the offer
- Delivery and shipping
During the secure payment process, the Buyer has the possibility of choosing a method of receiving the product via Mondial Relay or another partner carrier (InPost, Colissimo): they must choose their pickup point or delivery method then enter their identity information.
The Seller has a period of 5 days to ship their parcel. Failing this, the sale will be automatically canceled and the buyer fully refunded.

The buyer can validate their purchase or open a dispute in the event of anomalies upon receipt of their parcel. If the buyer does not validate 48 hours after receipt, then the sale is automatically validated. If the buyer opens a dispute, Opla will intervene to look into the extent to which Opla can intervene in order to satisfy both parties.
- Receipt of the money on the wallet
The User will then have the possibility of keeping this sum on their wallet or of making a transfer to a bank account after having filled out a form requesting IBAN, account name, etc.
It should be noted that a purchase from a professional is carried out in the same way with a few exceptions:
- The professional seller offers the Buyer a period of 15 days, following receipt of their order, for the right of withdrawal.
- The professional seller will therefore receive the amount of their sale on D+15 on their wallet. Opla remaining the guarantor of the amount during the withdrawal period.
Article 7 - Secure payment methods
European regulations have put in place provisions aimed at strengthening the security of electronic payments, in particular on the internet, and access to safer online banking services. Thus, as of 14 September 2019, the use of the single code received by SMS to authenticate these operations is no longer sufficient and is progressively reinforced by means of a device compliant with the new regulations. These new devices may for example rely on an application, for smartphone or SIM card (compatible with all mobiles), which requires the entry of a secret code or the verification of biometric data. These solutions are chosen by banking institutions and payment service providers, and offered to their customers. For more information, please contact your usual banking institution or payment service provider.
Possible payment methods:
- Bank card
The Customer may pay for their order by bank card (Carte bleue, Visa, Eurocard/Mastercard, American Express, China UnionPay, eftpos Australia, Japan Credit Bureau) in accordance with the provisions of this article.
To pay for their order by bank card, the Buyer must provide the name of the cardholder, the number of their bank card and, depending on the type of the latter, its expiration date as well as the cryptogram number (3-digit number appearing on the back of their bank card). It is specified that to make their payment by bank card, the Buyer has been automatically transferred to an electronic payment server. The server is secured by S.S.L (Secure Socket Layer) encryption so as to protect as effectively as possible all the data related to the payment methods, and so that, at no time do the Buyer's banking data transit through Opla's computer system.

- Opla Wallet
For the creation of this wallet, a “KYC” procedure is put in place internally based on the regulations on combating money laundering and the financing of terrorism. If your KYC verification is not conclusive, you will not be able to open an Opla wallet.
Following a sale, the User funds a wallet that they can choose to spend on Opla at checkout. If this wallet is not sufficient, it will be supplemented by another payment method.
The wallet is not a bank account and may not be used as such.
The funds of the users' wallets are held in escrow, until a request for a transfer to a bank account, on a dedicated account with Société Générale, a Public Limited Company with share capital of 958,618,482.50 euros Registered with the Paris Trade and Companies Register under unique identification number 552 120 222.
Article 8 - Responsibilities and Obligations
As a User you undertake not to disseminate/share:
- any false and/or misleading mandatory information.
- any information infringing the rights of a third party.
- any photograph (i) for which they do not hold the intellectual property rights or express authorization to use from the rights holder, (ii) in which persons other than themselves are visible unless these persons have given their consent to the publication of these photographs, (iii) in which personal data is visible.
- insulting, violent, defamatory or racist remarks/content within the messaging.
Finally, the User is responsible for any direct or indirect damage that a User could suffer as a result of inaccurate, incomplete and/or misleading information provided during registration or in the absence of an update of this information, and for which the User alone shall bear the consequences;
As a Seller you undertake to:
- offer in your Listings only Goods available and in your possession.
- comply with the legislation in force and act in good faith.
- not publish fraudulent, illegal, counterfeit items or content, or content infringing the rights of others.
- not use unauthorized automated tools to interact with the platform.
- not promote other sites or services without authorization.
- not publish content contrary to public order, security or morality.
- not make inappropriate remarks in your listings or in the messaging.
- properly define the condition of the product posted online (such as like new, very good condition, etc.).
- remove the listing if the product is no longer available.
On Opla's side:
Opla makes all necessary efforts to ensure that the platform and the services are accessible and function correctly 24 hours a day, 7 days a week. Nevertheless, given the limits of the Internet, Opla cannot exclude that access to and the functioning of the platform and the Services may be interrupted, in particular in the event of force majeure, malfunction of the User's equipment, malfunction of the User's Internet network or maintenance operations intended to improve the Application or the Site and the Services. Consequently, Opla cannot be held responsible for any interruption of the Services, whether voluntary or involuntary, it being specified that Opla undertakes to do its best to limit the interruptions attributable to it. Opla cannot be held responsible for the frequency of presentation of the Sellers' profiles on its Application or the Site. Opla and the User are independent parties, each acting in its own name and on its own behalf. Opla makes every effort to ensure the content and validity of the information and documents transmitted by the Seller on the Application or the Site, provided that they are established in France, Belgium, Luxembourg, the Netherlands, Spain or Portugal. However, Opla cannot be held responsible in any way whatsoever for the failures to comply with the obligations incumbent upon it, in particular within the framework of combating undeclared work and compliance with transparency rules, nor for the damages that may result therefrom. Consequently, Opla cannot be held responsible for the false, misleading or obsolete information communicated to it by the Seller.
Article 9 - Content moderation
The Seller declares that they recognize and accept that they are solely responsible for the content of the listings or products sold that they publish and make accessible to Users, as well as for any document or information that they transmit to Users. The advertiser assumes full editorial responsibility for the content of the Listings or products sold that they publish.
Consequently, Opla reserves the right to:
- delete, without notice or compensation or right to a refund, any content and/or Listing brought to its attention likely to infringe the rights of a third party and/or that does not comply with the listing referencing rules.
- delete, at any time, without compensation or right to a refund of the sums committed by the advertiser for the purposes of subscribing to Paid Options, an account that would be contrary to French law and/or to the rules of referencing and de-referencing of listings.
- suspend or prohibit access to Opla, in particular to the Messaging, of any User not complying with these Terms of Use
- immediately suspend the Seller's/Buyer's account as well as the ongoing Transactions in the event of suspicion of any fraud whatsoever.
Opla also reserves the right to suspend, as a precautionary measure, any transfer of funds due to a User whenever the Fraud Department identifies reasonable doubt as to:
- the authenticity of the identity declared by the User;
- the lawfulness of the origin of the funds or of the transactions carried out on the Platform;
- an attempt at fraud, money laundering, terrorist financing, or any other unlawful activity;
- any anomaly in the User's transactional behaviour (volume, frequency, amounts, atypical sales pattern).
This suspension may be maintained for a maximum period of 90 (ninety) calendar days from its implementation, for the time needed to carry out the internal checks and investigations, including, where applicable, in coordination with the partner payment institutions and/or the competent authorities.
If the investigation does not reveal any irregularity, the funds are released and the transfer is executed as soon as possible. If the investigation confirms fraud, attempted money laundering or any other unlawful activity, Opla reserves the right to:
- permanently close the User's account;
- retain the funds pending instructions from the competent authorities;
- take any appropriate legal action.
Opla applies a zero-tolerance policy towards any attempt at money laundering, fraud or use of the Platform for unlawful purposes. Any substantiated suspicion systematically leads to the opening of an investigation by the Fraud Department, regardless of the amount or frequency of the transactions concerned.
- restrict the use of the Opla service (in particular to refuse or limit the number of Listings that the Advertiser can post online) in the event of the dissemination of listings by a seller registered as a Private individual holding a Personal Account, whose activity may be likened to a professional activity.
- suspend for a period of 12 months the Personal or Pro Account of a User only after three attempts to post a Listing contrary to intellectual property rights.
Article 10 - Right of withdrawal and disputes
Right of withdrawal:
From professionals:
The Buyer may only exercise their right of withdrawal within the framework of a transaction carried out via online Secure Payment from a professional Seller. After having carried out a transaction via Secure Payment from a professional Seller, the Buyer has a period of 15 full days to withdraw from the effective delivery of the product.
The return shipping fees of the product remain the responsibility of the Buyer and the return of the product is done under their responsibility.
The refund by the professional seller may be made once the latter has the product in question.
For any Transaction taking place between two private individuals, the Buyer cannot invoke a right of withdrawal and therefore cannot request the refund or exchange of the product from the Private Seller through Opla. They may open a dispute during the 48 hours following receipt of the parcel.
The buyer may, however, cancel their order as long as the Seller has not shipped it. Once shipped, it is no longer cancelable.
Disputes:
Within 48 hours after having received their parcel, the buyer may refuse a sale and declare a dispute. At that moment, Opla will intervene by requesting more information from the person declaring the dispute.
Opla wishes to specify that in the event of a listing created with photos generated solely by Artificial Intelligence, the seller will not be protected during a dispute. At least one reliable and real photo must appear in the listing so that the resolution of the dispute can take place under the best conditions.
In the case where the seller is a professional seller, within the meaning of Directive 2011/83/EU on consumer rights, you have a legal right to terminate the purchase contract with the professional Seller without giving any reason, to return the item to the Seller and to obtain a refund.
You have 15 calendar days to exercise your right of return. The 15-day period runs from the day following the delivery of the Item. If the 15th day falls on a weekend or a public holiday, you have until the next business day.
Lost parcels:
In the event of parcels lost by the carrier, Opla offers the following guarantees:
Mondial Relay/Inpost: Refund of the buyer. Compensation of the seller up to €20.
Colissimo: Refund of the buyer. Compensation of the seller up to €20.
Article 11 - Paid options
Subscription to one or more paid option(s) is exclusively accessible to Users logged into their account from the Website and/or the Applications. A paid option is subscribed only for a single listing. Consequently, it is not possible to transfer the benefit of a paid option from one listing to another.
The listing “boost” is a paid option on Opla.
You can move your listing up to the top of the search results within the listing's category for 3 days, 7 days or 15 days. The price varies depending on the option chosen. Opla does not refund the boost if the listing has been deleted/reported as non-compliant in the meantime.
The dressing “boost” is also a paid option on Opla. You can feature your profile within the shop for 3, 7 or 15 days. Your profile will appear in the shop categories most appropriate to your items. The price varies depending on the chosen option.
Article 12 - Intellectual Property
All intellectual property rights (such as in particular copyright, related rights, trademark rights, database producer rights) relating both to the structure and to the contents of the Application or the Site, and in particular the images, sounds, videos, photographs, logos, trademarks, graphic, textual, visual elements, tools, software, documents, data, database, etc. (hereinafter collectively referred to as the "Elements") are reserved. These Elements are the property of Opla. They are made available to Users, free of charge, solely for the purposes of using the Application or the Site and this within the framework of a normal use of their functionalities and within the limits described herein. Users undertake to make no modification to these Elements. Any use not expressly authorized of the Elements of the platform constitutes a violation of the rights of Opla, also likely to entail a violation of image rights, the rights of persons or any other rights and regulations in force. Such use may therefore engage the civil and/or criminal liability of its author and Opla reserves the right to initiate any action, including judicial, against the persons who do not comply with this article. The Opla trademarks and logos are registered trademarks. Any total or partial reproduction of these trademarks and/or logos without the prior written authorization of Opla is prohibited.
The content of the listings or products sold that are posted belongs to the Users, nevertheless, by posting listings or products sold on the Application or the Site, the User grants Opla the non-exclusive, transferable, sub-licensable right of exploitation, free of charge, for the entire world over the whole content of the listings or products sold and in particular over the photographs, texts, videos, drawings, illustrations, trademarks, logos, titles, descriptions, as they are published on the Application or the Site, as well as a license over all the intellectual property rights relating to the Content and in particular over the copyrights relating to the elements used in their Listing, such as photographs, texts, videos, drawings, illustrations, sound elements, and this for the entire legal duration of their intellectual property rights and for the entire world.
The rights thus granted include the right to reproduce, represent, disseminate, adapt, modify, create a derivative work, translate all or part of the Content by any process, in any form whatsoever and on all media (tangible or intangible, digital, printed…) known or unknown to date, within the framework of the exploitation of the Application or the Site.
Article 13 - Identity verification
Opla offers its Users the possibility of voluntarily verifying their identity in order to obtain a “Verified” badge, visible on their profile to the other Users of the Platform. This verification is optional: it is not required to use Opla's basic features, but helps strengthen trust between buyers and sellers. Identity verification is carried out through our partner Didit, a specialised third-party provider, which performs:
- the verification of the User's phone number;
- the verification of a valid official identity document (national identity card, passport, or any other equivalent document depending on the country of residence).
The entire process is secure, in accordance with the security standards in force. Identity verification is offered at the price of €1 (one euro), charged at the time of the verification request. This amount covers the processing costs related to the verification and is non-refundable once the verification has been carried out, whether or not it results in the badge being obtained. The documents submitted as part of this verification are stored securely by Didit and/or Opla, in compliance with the applicable regulations on personal data protection (GDPR).
The User acknowledges and accepts that Opla reserves the right to access these documents:
- in the event of a dispute between Users;
- in the event of suspected fraud or unlawful activity;
- at the request of the competent authorities, within the scope of their legal powers.
Obtaining the “Verified” badge only attests that the identity declared by the User has been confirmed by the verification process described above. It does not in any way constitute a guarantee by Opla as to the behaviour, reliability or honesty of the User in the context of their transactions on the Platform.
Article 14 - Hypertext Links
The Opla Application or Site may contain hypertext links redirecting to sites operated by third parties. These links are provided for information purposes only. Opla exercises no control over these sites and declines all responsibility regarding access to, the content of and/or the use of these sites, as well as the damages that may result from the consultation or use of the information present on these sites.
Article 15 - Updating of the GTU
Opla reserves the possibility of modifying, at any time, all or part of the GTU. Users are invited to consult these GTU regularly in order to be aware of any changes made. The Use of the Application or the Site by Users constitutes acceptance by the latter of the modifications made to the GTU.
Article 16 - Applicable law
The GTU are governed by French law. If one of the provisions of the GTU is deemed illegal or invalid by a competent court, the validity and applicability of the other provisions shall not be affected thereby.
Article 17 - Fiscal Obligation
In accordance with European Directive 2021/514 (“DAC7”), Opla is required to collect and report annually to the tax authorities information relating to Sellers who, over the calendar year, have either completed more than 30 sales or a total sales amount exceeding €2,000. The information collected includes: surname, first name, address, date of birth, tax identification number (TIN), IBAN used for transfers, total sales amount and number of transactions. The Seller undertakes to provide this information at Opla's request. Failing this, and in accordance with the directive, Opla may suspend the Seller's account until regularization, and withhold the sums held in the wallet. This data is retained for the legal period required by the applicable tax regulations.
