Personal Data and Cookies

So that you can use the Opla Service with complete confidence, this Personal Data Privacy Policy describes the terms and conditions under which Opla collects, processes and protects your personal data.

Article 1 - Type of data collected

Account creation

When you create an Account on Opla, you must provide us with the following information: Country, Language, Email address, Username.

Users can also log in to the Application or the Site via a Google or Apple identifier ("Social Login"). Opla therefore also processes usage data (the Social Login, IP addresses, browser type, browser version, pages of the Application or the Site that Users visit, time spent on these pages, time and date of visits and unique device identifiers and other diagnostic data).

The data you provide to us is also used to subscribe you to our newsletter in order to inform you about our news and services, send you commercial and promotional offers, compile statistics and, if you agree, send you offers from our partners.

The user may also be required to provide us with the following information when using the Application or the Site: Photograph, Postal address, Last name, First name, Iban, Credit card number, expiration date.)

All financial and sensitive data is secured via encryption compliant with PCI DSS and HTTPS standards to guarantee the security of your information.

Responding to a Listing When you respond to a 'listing' or make a request for additional information regarding a product, we transmit to the seller your pseudonym, your message and the data entered in any additional fields so that the seller can follow up on your contact request. IF the seller is a professional, you agree that we also transmit this information to them.

Use of customer support or reporting

When you contact our customer support, you must provide us with your pseudonym, your name, or email address in order to identify you. You may also provide us with personal data in the subject or body of your message.

Use of our Messaging

As part of our messaging, we use technology for the automatic analysis of message content, in order to detect unsolicited content, including fraudulent content, or malicious computer programs.

The automatic collection of your data through your use of our services

We record usage data when you access (or use in any way) our services, in particular when you carry out a search or publish a product. In particular, we carry out audience measurements; for example, we measure the number of pages viewed, the number of visits to the site, as well as the activity of visitors on the site and their frequency of return. We use login identifiers and cookies as well as your IP address to identify you and to record your activity.

We are also likely to collect technical data about your internet connection, your browser and your devices.

You can refuse all personalized advertising by activating the privacy functions on your mobile device, such as 'Limit Ad Tracking' (iOS) and 'Opt out of Ads Personalization' (Android). Consult the help system of your mobile device for more information.

Article 2 - Use of your data

  • On the basis of the performance of the contract between us, we use your data to provide you with our services, and in particular to:
  • ensure the publication of your listings;
  • ensure the creation and management of your account;
  • allow you to read the messages you receive and to contact other users;
  • sell your products;
  • send you emails concerning your use of our services;
  • answer your questions to customer support;
  • allow you to share a listing.

* On the basis of our legitimate interest, we use your data to:

  • produce statistics and marketing analyses, in order to understand how you use our services;
  • offer you personalized content and improve your user experience;
  • send you, as a user, commercial and/or promotional offers as well as information about our news;
  • combat fraud.

* We may, with your consent:

  • share your data with our advertising partners, data controllers, for the purposes of personalizing our advertisements, on our site or on third-party sites.

We do not share your personal data with our third-party partners without your consent. However, if you click on an advertisement, its advertiser may know that you have viewed the page where you clicked.

  • Finally, we may process your data for evidentiary purposes and as part of compliance with our legal obligations.

Article 3 - Recipients of the data

As part of the processing of the User's Data, Opla may transmit or give access to it to the following categories of Data subcontractors:

  • The service provider for the hosting and maintenance of the Application or the Site;
  • Service providers responsible for marketing analysis and Customer segmentation;
  • With other Users: when the User shares personal information or otherwise interacts with other Users in public spaces, this information can be seen by all Users and may be publicly disseminated externally. If Users interact with other Users or register through a third-party social networking service, the User's contacts on the third-party social networking service may see the User's name, profile, photos and activity description. Likewise, other Users will be able to view the descriptions of Users' activities, communicate with them and view their profile.
  • Other parties: With the User's consent, Opla may disclose Data for any other purpose to which the User has consented.

Finally, Opla may be required to communicate this data to third parties when such communication is required by law, regulation or a court decision, or if such communication is necessary to ensure the protection and defense of its rights or to guarantee the personal safety of the users of the platform or of the public. Apart from these cases, users' data will not be transferred or made accessible to a third party, subject to any restructuring of Opla, including the total or partial contribution of assets, merger, absorption, acquisition, demerger and more generally any reorganization operation.

Article 4 - Retention period

Opla retains the data for the period strictly necessary to achieve the objectives for which it was collected. Opla may store the Data if its storage is reasonably necessary to comply with its legal obligations, satisfy regulatory requirements, prevent fraud and abuse, and enforce this privacy policy and the terms of use. Opla may retain the Data for a limited period, if required by law enforcement. When the Data is anonymized, Opla may retain it for as long as necessary for commercial purposes

Article 5 - Your rights

In accordance with the regulations on personal data, you have the following rights concerning your personal data:

  • Access: this is your right to obtain confirmation as to whether or not your data is being processed, and if so, to access this data;
  • Rectification: this is your right to obtain, as soon as possible, the rectification of your inaccurate data, and the completion of your incomplete data;
  • Deletion/Erasure: this is your right to obtain, as soon as possible, the erasure of your data, without prejudice to obligations or other retention requirements;
  • Restriction: this is your right to obtain the restriction of processing when you object to it, when you contest the accuracy of your data, when you believe that its processing is unlawful, or when you need it for the establishment, exercise or defense of your rights in court;
  • Objection: this is your right to object at any time to the processing of your data. You may also object to processing carried out for prospecting purposes;
  • Portability: this is your right to receive your data in a structured, commonly used, machine-readable and interoperable format, and to transmit it to another data controller without us obstructing it;
  • You have the right not to be subject to a decision based exclusively on automated processing producing legal effects concerning you or affecting you, except where this decision is necessary for the conclusion or performance of a contract, is legally authorized;
  • You have the right to lodge a complaint with a supervisory authority;
  • You have the right to give directives on the fate of your personal data in the event of death.

You may also, at any time, modify the personal data of your User Account. Simply go to your Account and click on the "My Profile" tab. As part of a newsletter subscription, you can at any time click on the unsubscribe link to unsubscribe from the newsletter. Article 6 - Cookie Policy

Opla wishes to inform you clearly and transparently about the use of cookies while you browse our site and our applications. I - What is a cookie? A cookie is a text file stored on the hard drive of your terminal (computer, tablet, mobile) by means of your browsing software when consulting an online service. The word "cookies" in this cookie policy designates all trackers and other similar technologies that may be used on our website and our applications. Cookies do not cause any damage to your device, but make it easier, for example, to retrieve your preferences, pre-fill certain fields and adapt the content of our services. You alone choose whether you wish to have cookies saved on your device and you can easily control the saving of cookies. II - The cookies used by Opla 1. Cookies necessary for the operation of the service

The cookies necessary for the operation of the service that we issue allow us:

  • to identify you when you log in to your account and to secure your connection;
  • to provide the essential features of the service or those activated by the user (search, bookmarking of listings, etc.)
  • to adapt the presentation of our sites, applications and advertising spaces to the display preferences of your terminal (language used, display resolution, operating system used, etc.), according to the viewing or reading hardware and software that your terminal includes;
  • to retain the configuration of your cookie choices.

These cookies have a retention period of 13 months.

Because they are necessary for the proper functioning of the service, these cookies do not require your consent. You may nonetheless object to them and delete them using your browser settings; however, your user experience may be degraded (inability to log in to your account, unavailability of certain features, etc.). 2. Audience measurement cookies We use audience measurement cookies that allow us to analyze their use and improve their content and ergonomics by establishing statistics and volumes of attendance and use (sections and content visited, navigation paths...).

We inform you that:

  • If you accept audience measurement cookies, we carry out a complete measurement using indirectly identifying personal data, allowing us to obtain more precise statistical results and to improve our service;

Personalized advertising cookies Subject to your consent to the purpose of personalized advertising, we use cookies in order to create user profiles and to provide you with targeted advertising content relevant to you and your interests, on our site as well as on third-party sites, as explained in our Privacy Policy.

Targeted advertising cookies are also used:

  • to limit the number of times you see an advertisement and to help measure the effectiveness of an advertising campaign;
  • to allow us to know whether a user who has seen an advertisement subsequently visited the advertiser's site and did something there (for example, subscribing to a newsletter).

The refusal of these cookies has no impact on your navigation and on the service. III - Your choices regarding cookies When you arrive on our site/application for the first time or when we have to request your consent again (because our use of cookies has changed or your choice is more than 6 months old), a banner describing our use of cookies appears:

  • By clicking on "I accept all" (or equivalent), you accept our use of cookies for all the purposes described in the banner and this policy;
  • By clicking on "No thanks" (or equivalent), you refuse the use of cookies subject to consent. Only the cookies necessary for the operation of the service (including consent-exempt audience measurement cookies) that do not require your agreement will be placed on your browser.

Your choice is valid only for the terminal from which you access the service. It is retained for 6 months. Please note that we use cookies to retain the settings and date of your choice: if you delete them, we will no longer be able to know your choice and our banner will be displayed to you again.
